These Terms are a binding agreement between you and Marion Learning Academy ("we," "us," "our") and govern your use of marionlearningacademy.com and your enrollment in any class we offer. By enrolling in a class, whether for yourself or on behalf of your child, you agree to these Terms.

These Terms apply across every class we offer, for both adult students and children enrolled by a parent or guardian. Individual classes may have additional requirements specific to that class, such as a recording consent form, which are incorporated into these Terms for that enrollment.

1. Eligibility & Who May Enroll

Our classes are offered to both adults and children, depending on the class. Where a class is open to adults, you must be at least 18 years old to enroll yourself. Where a class is designed for children, enrollment must be completed by a parent or legal guardian on the child's behalf, and the parent or guardian is the one who agrees to these Terms.

By enrolling a child in a class, you represent that you are the child's parent or legal guardian and are authorized to agree to these Terms, our Privacy Policy, and, where applicable, our Children's Privacy Notice, on the child's behalf.

2. Enrollment & Payment

Enrollment in a class requires completing that class's enrollment process (which may include a consent form) and submitting payment
Enrollment is not confirmed, and a seat is not reserved, until payment is successfully completed
Class sizes may be limited, and enrollment may close once capacity is reached
Prices, schedules, and class details are as described on the individual class's enrollment page at the time you register

3. Class Formats

We offer classes in different formats, which will be described on each class's enrollment page. This may include live, instructor-led classes delivered over video call, and self-paced classes delivered on-demand. Some live classes may be offered as founding or beta sessions, meaning the class is being taught for the first time in that format and student participation may shape how the material is refined for future offerings.

4. Parent/Guardian Responsibilities

This section applies whenever you enroll a child in a class. By doing so, you agree that:

You will supervise your child's participation at the level you judge appropriate for their age and maturity
Where a class involves hands-on activity, including any step involving heat, sharp tools, or ingredients that could pose a risk, a parent or guardian will personally handle those steps, as described on the specific class's enrollment page
You are responsible for reviewing any project materials or ingredients for sensitivities or allergies relevant to your child
You will explain the relevant parts of these Terms to your child as appropriate for their age

5. Recording & Privacy

Some classes are recorded. Where a class is recorded, how the recording is created, shared, and eventually removed will be described on that class's enrollment page and consent form. Our general privacy practices are described in our Privacy Policy, and classes involving children are additionally governed by our Children's Privacy Notice.

6. Code of Conduct

To keep our classes a safe, respectful space for every student:

Treat instructors and other students with respect and kindness
No harassment, bullying, hate speech, or discriminatory language or behavior toward any student or instructor
No sharing of another student's or family's personal information without their consent
Class recordings and materials are for the personal, non-commercial use of enrolled students only, and may not be redistributed, posted publicly, or shared outside the enrolled group

We may remove a student from a class, without refund, for a serious or repeated violation of this Code of Conduct.

7. Course Materials & Intellectual Property

All course materials, including recordings, workbooks, guides, and other content we provide, are owned by Marion Learning Academy and are protected by copyright. When you enroll in a class, we grant you a limited, personal, non-transferable license to use those materials for your own or your child's education. You may not copy, resell, redistribute, publicly post, or create derivative works from our course materials without our written permission.

8. Educational Purpose Only, Not Medical Advice

Our classes, including those covering herbalism and herbal preparation, are educational in nature. They do not provide individualized medical advice, diagnosis, treatment, or dosing guidance for you, your child, or anyone else. Always consult a qualified healthcare provider before using any herbal product, especially if pregnant, nursing, managing a medical condition, or giving anything to a child. You, or the supervising adult in a children's class, are solely responsible for evaluating ingredient sensitivities and deciding whether any finished project is appropriate to use.

9. Refunds & Cancellations

Refund and cancellation terms are described in full in our Refund & Cancellation Policy, which forms part of these Terms. Specific classes may also have their own cancellation terms noted on their enrollment page, which will control for that class if they differ.

10. Disclaimer of Warranties & Limitation of Liability

Our classes and website are provided "as is," without warranties of any kind, express or implied. We do not guarantee that any class will be uninterrupted, error-free, or meet your particular expectations.

To the fullest extent permitted by law, our total liability to you arising out of your enrollment in any class, or your use of our website, is limited to the amount you paid for that specific class. We are not liable for any indirect, incidental, or consequential damages, including any injury, allergic reaction, or other harm arising from the use of ingredients, equipment, or materials associated with a class, except where caused by our own negligence.

11. Indemnification

You agree to indemnify and hold Marion Learning Academy harmless from any claims, losses, damages, or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your misuse of course materials, or, where applicable, your child's participation in a class.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law principles. Before filing any formal claim, we ask that you first contact us at info@marionlearningacademy.com so we can try to resolve the issue directly. Any dispute that cannot be resolved this way will be subject to the exclusive jurisdiction of the state and federal courts located in Florida.

Larger platforms in this space often require binding arbitration and a class-action waiver in this section. We have not included those provisions here; if you want the stronger legal protection they can offer as your class catalog grows, this is a good section to review with an attorney.

13. General

Entire Agreement: These Terms, together with our Privacy Policy, Children's Privacy Notice (where applicable), and Refund Policy, are the entire agreement between you and us regarding your enrollment.
Changes to These Terms: We may update these Terms from time to time. Continued enrollment in future classes after an update constitutes acceptance of the revised Terms.
Severability: If any part of these Terms is found unenforceable, the remaining provisions will continue in full effect.
No Waiver: Our failure to enforce any part of these Terms is not a waiver of our right to do so later.
